The registration phase for Turkey REACH has kick-started by 1st of January 2021 as the deadline for pre-registration was passed. During the pre-registration phase, GPC has pre-registered around 3200 substances to secure business of our clients for the upcoming years in Turkey.

According to the latest updates from the ministry, the pre-registration will be possible until the end of the registration phase, 2023-12-31 but it is crucial to submit pre-registrations as soon as possible to benefit from joint registration and actively participate in SIEFs.

 If you haven’t pre-registered your substances, you can send the list of your substances to us and as your seamless global regulatory extension, GPC will pre-register your substances as well as represent your company in the SIEFs. Please keep in mind that it is important to contact us as soon as possible to be able to benefit from the advantages of joint registration.

The amended SEA Regulation, the “Bylaw on Classification, Labeling and Packaging of Substances and Mixtures” (the CLP regulation) in Turkey, was published on 10 December 2020 in the Official Gazette No.31330. This amendment harmonized the EU CLP 13th Adaptation to Technical Progress (ATP) but excluding 12th ATP. Important updates are summarized here:  

• Nearly 110 substances were added to the classification list in Article 6 

• New hazards classification was added to the 108 substances  

• Notification applies to not only hazardous substances but all substances subject to KKDIK registration 

• Annexes 7-11 were removed to avoid redundancy from implementing KKDIK  

• This new amendment has two-years-transition periods, which reclassification and relabeling applies for substances and mixtures being placed on the market after 1 January 2023  

• KKDIK registered substances are exempted from classification and labeling notification 

• Mandated Poison Center Notification by 1 January 2025

On November 11.2020, the chemical registration IT System of KKDIK (Turkey REACH) was updated. The updated system is more user-friendly and slightly different than the previous one in terms of usage and information requirements.

Previously, registrants only needed to provide CAS or EC number of the substance and the name to be registered. In the updated version of the system, it is now obligatory to provide the information on tonnage band of substance in concern. Since tonnage band information was not a compulsory information before, all substances that were pre-registered in the previous version should be reviewed and updated with the tonnage band information.

In the new system, the way of pre-registration has also been changed: Now for each represented company a new profile is created through the Only Representative login and substances are managed separately in each profile. This way, it is expected to have easier segregation of different supply chains and downstream users in Turkey can easily notify themselves by simply adding the new profile as their supplier.

The deadline for pre-registration of KKDIK is fast approaching! After December 31, 2020, substances that have not been pre-registered will not be allowed to be placed in the Turkish market. The Turkish Toy Regulation has entered force on October 4th, 2016 and has been regulating the toy products since then with the purpose of defining methods and foundations of security and free circulation of toys.

The regulation was updated recently in December 2019 to amend some maximum limits of substance containment such as chromium and lead, as well as Overall Migration Limits (OML) of Bisphenol A and Phenol in the light of recent data to ensure toy security.

Limit of Chromium (VI) in recyclable toy products has been lowered from 0.2 mg/kg to 0.053 mg/kg, while the presence of lead was strictly dropped to 2 mg/kg from 13.5 mg/kg in breakable or soft toys, from 3.4 mg/kg to 0.5 for sticky or fluid toys, and finally from 160 to only 23 mg/kg for recyclable toys.

The Ministry of Environment and Urbanization of the Turkish Republic has published the draft of the price list for registration fees.

It is known from the regulation from before that registration, updating registration, request on confidentiality, product & process-focused R&D notification, authorization (permit) application, and evaluation of authorization activities will be subject to official fees.

According to the published list, the minimum fee will be 50 Turkish Liras (5.5 EUR)  for joint registration up to 10 tpa by a micro-sized company and the maximum fee will be 15k Turkish Liras (1640 EUR) for self-registration more than 1000 tpa by a large-sized company.

It is also pointed out that these fees are subjected to change as the final list will be published by 2021.

According to the latest update from the Ministry of Environment and Urbanization of Turkish Republic, pre-SIEF notification module in KKS (Chemical Registration System) will be kept active even after the pre-registration deadline, 31st December 2020. 

The reason was explained to be make it easy for registration activities to participate in SIEF (Substance Information Exchange Forum).

Although the Ministry have just made late pre-registration possible, it was also pointed out that substances that are not pre-registered by the upcoming deadline will not be allowed to placed in the Turkish market unless they complete both pre-registration and registration processes.

This can be interpreted that a longer process will be needed if the pre-registration is not complete before the deadline.

It is already known that after the deadline, substances that are pre-registered will not need to register until the end of 2023, the deadline for registration, to be placed on the Turkish market.
