Regulation on the Export and Import of Hazardous Chemicals Has Been Published

The Ministry of Environment and Urbanization and Climate Change of Turkey published the "Regulation on the Export and Import of Certain Hazardous Chemicals" on 28 January 2023 in order to comply with the Rotterdam Convention, in which the export and import of harmful chemicals are regulated within the framework of certain rules in order to protect the environment and human health. This regulation came into force within the scope of harmonization studies of the “PIC” regulation published in Europe on March 1, 2014.  It is aimed to bring some regulations on the use of harmful chemicals and to share information on the effects of chemicals with this regulation.
 
In accordance with this regulation, the list of chemicals PIC regulated has been published. The volume of chemicals used in the previous year must be reported by 31 March of each year. Also, it was emphasized that a safety data sheet prepared in the official language or languages ​​of the target country and within the scope of the Regulation on Chemical Registration, Evaluation, Authorization, and Restriction (KKDIK) should be submitted together with the chemicals when the chemicals in question are exported.
 
Within the scope of this regulation below will be covered.
 
- To protect from the harms of some dangerous chemicals and to increase cooperation in international trade
- To prohibit or restrict certain chemicals in compliance with the Rotterdam Convention, to make a preliminary export notification before exporting
- To make import and export notifications of chemicals within the scope of PIC Regulation through a system
- To make notifications of the previous year's amount of information on chemicals within the scope of PIC Regulation until March 31 of each year
- To make the information about the exported hazardous chemicals and the importing party available to the public
 
The actions that exporters should take are summarized below.
  • Make an export notification before export and provide the information in Annex-3 to the Ministry for notification for chemicals in Annex-1 of the Regulation,
  • Provide information about the annual amount of chemicals in Annex-1 and Annex-2 of the Regulation and the name and address of the importer to the Ministry,
  • Provide a Safety Data Sheet in the official language or languages ​​of the imported country to the importing party together with the chemicals exported within the scope of this regulation,
  • Export the chemicals within the scope of this regulation in a packaged and labeled form in accordance with the Regulation on Classification, Labeling, and Packaging of Substances and Mixtures,
  • Ensure the transfer of information through the Ministry’s e-ÖBK system and comply with the rules determined by the ministry,
  • Do not export the chemicals in Annex-6 of the Regulation,
  • Provide additional information requested by the Ministry,
